These Terms of Service ("Terms") govern your access to and use of the Stack website (get-stack.com), health assessment, subscription service, and all related services (collectively, the "Service"), operated by Lux Enterprises LLC, a Wyoming limited liability company ("Stack," "we," "us," or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old to use Stack. By creating an account or placing an order, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
IMPORTANT — NOT MEDICAL ADVICE
Stack provides personalized supplement recommendations based on self-reported health information and AI-driven analysis. OUR SERVICE IS NOT MEDICAL ADVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE. Supplements recommended by Stack have not been evaluated by the U.S. Food and Drug Administration (FDA). Always consult a qualified healthcare professional before starting any supplement regimen, especially if you are pregnant, nursing, taking medication, or have a medical condition. If you experience any adverse reaction, discontinue use immediately and consult your healthcare provider.
No Guarantee of Results
Individual results from supplement use vary significantly based on factors including genetics, diet, lifestyle, existing health conditions, and consistency of use. We do not guarantee any specific health outcomes, improvements, or results from using our products. Testimonials and reviews on our website reflect individual experiences and should not be interpreted as a guarantee of similar results.
Health Assessment Accuracy
The accuracy of your personalized recommendations depends on the accuracy and completeness of the information you provide in the health assessment. You are responsible for providing truthful and accurate information. Stack is not liable for recommendations based on inaccurate or incomplete self-reported data.
Subscription and Billing
By subscribing, you authorize us to charge your payment method on a recurring monthly basis at the then-current price. Your subscription renews automatically each month until cancelled. You may cancel or pause your subscription at any time through your account dashboard or by contacting hello@get-stack.com. Cancellations take effect at the end of your current billing cycle — you will continue to receive your current month's order.
Pricing
All prices are listed in US dollars and are subject to change. We will notify you of any price changes before your next billing cycle. Continued subscription after a price change constitutes acceptance of the new price.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@get-stack.com if you suspect unauthorized access.
Prohibited Conduct
You agree not to (a) use the Service for any unlawful purpose, (b) provide false information in the health assessment, (c) attempt to reverse-engineer our recommendation algorithms, (d) interfere with the operation of the Service, or (e) resell or redistribute our products without authorization.
Intellectual Property
All content on this website — including text, graphics, logos, images, software, and recommendation algorithms — is the property of Stack or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
Assumption of Risk
You acknowledge that dietary supplements carry inherent risks, including potential allergic reactions, interactions with medications, and individual sensitivities. By using our products, you voluntarily assume these risks. You acknowledge that you have had the opportunity to consult with a healthcare professional before using our products.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH-RELATED DAMAGES, ARISING FROM YOUR USE OF THE SERVICE OR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO STACK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold harmless Stack and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Dispute Resolution
Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting hello@get-stack.com. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in the State of Delaware. YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 14 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
